Regulations for the provision of electronic services and makingpurchases ofthe online store www.movimet.pl
1.1.These Regulations for the provision of services by electronic means (hereinafter referred to as "Regulations") define the types, scope and type of services provided by MOVIMET AIR ROMUALD MOŹDZIERZ, 68 JózefówStreet, 63-313 Chocz, NIP: 617-15-41-361, REGON: 251099219, www.movimet.pl.
1.2.Each customer is obliged to comply with these provisions from the moment of taking actions related to the use of the store's services.
1.3. The basis of the Regulations is the law Article 8 paragraph 1 point 1 of the Act of July 18, 2002.
on provision of services by electronic means (Journal of Laws No. 144, item 1204) (the "Act").
1.4 For each concluded transaction, the General Terms and Conditions of Sale (GTS) shall apply: https://movimet.pl/content/23-ogolne-warunki-sprzedazy. In case of conflict between the provisions of these Terms and Conditions and the GTS, the provisions of the GTS shall apply.
2.1.Customer - a natural person, legal entity or organizational unit without legal personality,whouses the services of the store www.movimet.pl or uses the sites made available by the service provider in accordance with the law, is obliged to comply with the following provisions.
2.2.Service provider - MOVIMET AIR ROMUALD MOŹDZIERZ,68 JózefówStreet, 63-313 Chocz, NIP: 617-15-41-361, REGON 251099219 (hereinafter referred to as service provider).
2.3.Store - referred to hereinalso asthe service constitutes an online store www.movimet.pl providing services in the field of sales, distribution ofproductsand services via ICT network, advertising, marketing, transportation, logistics, widely understood services
e- commerce, etc.
2.4.Act on provision of services by electronic means - sec. dated 18.07.2002. (Journal of Laws No. 144, item 1204).
2.5.Privacy Policy- rules for collection and processing of personal data of servicerecipients, as well as storage and protection of information.
2.6.Telecommunication system - a set of cooperating IT devices
andsoftware, ensuring processing and storage, as well as sending and receiving data via telecommunication networks by means of a terminal deviceappropriatefor a given type of network, within the meaning of the Telecommunications Law.
2.7.Electronic service - service performed by www.movimet.pl by sending and receiving data via telecommunicationsystemsfor the purpose of processing, including digital compression and storage, at the individual request of the Service Recipient, without simultaneous presence of the parties, while the data are transmitted via public networks within the meaning of the Act of July 21, 2000. - Telecommunications Law (Journal of Laws No. 73, item 852, as amended).
2.8.Telecommunications Law - the Law of July 16, 2004. - Telecommunications Law (Journal of Laws No. 171, item 1800, as amended);
3.1.access to the contact form, throughwhichthe service recipient can contact the service provider free of charge,
3.2.informational, in the form of contact details of the service provider, throughwhichthe service recipient can learn about the service provider's offer,
3.3.informational, marketing, commercial -concerning the possibility ofsending electronic e-letters, commercial offers and the possibility of purchasing services -goodsoffered by the service provider.
4.1.In order to properly use the services of the store it is necessary:
- connection to the Internet network,
- Internet browser supporting html language in the latest possible version,
- having an e-mail account.
4.2.The customer has the opportunity to contact the service provider free of charge by filling out the contact form or by phone.
4.3.It is prohibited for the recipient to provide unlawful content. If the Service Provider receives official notice or credible knowledge of the unlawful nature of the stored data provided by the Client, the Service Provider may prevent access to such data. The Service Provider shall not be liableto the Clientfor any damage caused by preventing access to data with unlawful content. If the Service Provider obtains credible knowledge of the unlawful nature of the data, it will notify the Client of its intention to prevent access to the data.
5.1. After selecting the goods, the Customer must click the "add to cart" button.
5.2. The selected goods are placed in the Customer's shopping cart, visible in theupper right corner of the online store. To go to the shopping cart, click the shopping cart icon or hover over and click "completeorder", then all the goods selected by the Customer placed in the shopping cart will be shown.
5.3. Toorder the selected goods you need to go through 5steps visible in the shopping cart :

5.4. If the customer has an account on the store's website, after logging into the account additional information is made available to the customer such as history of previousorders, delivery addresses provided.
5.5. After accepting the selectedgoods, the Customer chooses the method of delivery (e.g. shipping,personalcollection), enters the necessary data and choosesthe method of payment.
5.6. The customercan make payment in one of the selectedways:cash on delivery of the goods or prepayment after receiving the FV proforma.
5.7. Theorder is madeby clicking the icon, e.g. "I order and pay ".
5.8. After clicking the icon "I order and pay"., the customer is redirected to containing a summary of the transaction and then to a pagethat allows him to continueshopping.
5.9. Atany time beforepaymentis processed,the Customermay cancel theorder by exiting the sub-page used to finalizethe order.An order not completed with payment will not be processed.
5.10. Inorder to confirm the placement ofan order, an e-mail message containing a detailedordernumber will be sent to the Customer's e-mail address provided during registration and logging in to the account, whichwill enable theCustomerto check at what stage theorderis being processed.
5.11. The telephone number or e-mail address provided by the Customer may be used by the store to confirm theorderplacedor to clarify any doubts related to its execution.
6.1. Prices ofgoodsgiven on the website by the storeare gross prices in Polish zloty, including VAT.
6.2. The price of goods does not include the cost of shipment,which is determined individually after choosing the form of delivery by the customer.
6.3. The price of goods listed on the store's website afterthe customer places an order may not be the final price andmay change due to changes in theordermade by the buyer after the order process is completed, the price may also change if the components forcustom-madeproductsare changed or promotions introduced by the MOVIMET AIRstore .
6.4. The MOVIMET AIRstore reserves the right to make changes to the prices ofgoods on the store's website, to introduce newgoods aswellastoremove from the websitegoods no longer on sale, to organize promotional campaigns, in accordance with the applicable provisions of the Civil Code as well as otherlaws.
1.1. Goods presented on the website of the MOVIMET AIRstore are goods available at the time of their presentation or are produced on the individualorderof the customer only after placingan order.
1.2.In a situation when severalCustomers placean order for the same goods causing them to be out of stock, the Customer or Customerswho placethe order last will be notified individually, by telephone or e-mail, of the impossibility of fulfillingthe order if the MOVIMET AIRstore considers it necessary and fortechnicalreasons itwill not be possible to fulfill suchorder.
The customer will be immediately informedof the non-fulfillment ofan order placed by the customer due tostockshortagesor for any other reason beyond the control of the store, to the e-mail address provided by the customer or by telephone.
1.1.Delivery ofordered goods is carried out on the territory of Poland.
1.2.The realization ofthe order paid on delivery takes place immediately after placingthe order. Fulfillment ofan order paid by bank transfer takes place after receiving confirmation of receipt of payment on account of the store.
1.3.In the case of choosing the delivery of goods to the indicated address or to the stationary store, the goods will be sent to the customer at the time determined after placingthe order.
1.4.Ordered goods are delivered via courier service, the expected delivery time of theorder is up to 3 working days from the date of shipment.
10 .Forms of payment for theorder
10.1. Order can be paid by one of the followingmethods:
- cash on delivery, to the hands of the courier delivering the shipment;
- by traditional transfer made by the customer to the store's account indicated after placingthe order and sent in an e-mail to the customer, wherebythe order is processed only after thefundsare creditedto the online store's bank account.
10.2. The bank account number indicated on the web store's website is the correct one for making payments for the ordered goods. The store does not sendmessages to customers about changes in the bank account towhich payments should be made. If the Customer receives such a message - he is not obliged to make payment, he should in this case immediately inform the store about the message received and send it in an unchanged form to the address 68JózefówStreet, 63-313 Chocz.
11. Sales contract
11.1.Information placed on the website of the MOVIMET AIRstore does not constitute an offer to conclude a contract within the meaning ofthe Civil Code.
11.2.The contract may be concluded in the Polish language.
12. Delivery - cost
12.1. The cost of delivery depends on the selected method of delivery. The estimated cost of delivery is presented by the Information and Communication System when placing an order.
13. principles of withdrawal from the contract
13.1. The customer, within 30 days, has the right to withdraw from the contract of sale of goods, without giving any reason, the exception is the products manufactured on the individualorder of the customer, for theseproducts there is no possibility of withdrawal from the contract if the product has no hidden defects and is in accordance with theorder.
13.2.The right to withdraw from the sales contract expires after 30 days from the day the customer is in possession of the purchased item.
13.3.In order to exercise the right to withdraw from the contract of sale, the customer is obliged to inform the MOVIMET AIRstore by making a clear statement of intent in writing, by telephone, by e-mail.
13.4.Withdrawal from the contract can be made using the form located on the website of the store www.movimet.pl by printing it out, completing it and submitting it to the store by e-mail or by post to the address at 68JózefówStreet, 63-313 Chocz.
13.5.In the case of withdrawal from the contract of sale by the Customer, MOVIMET AIRstore will return to the Customer the payment received for the returned goods withoutshipping costs immediately after receipt of the statement of return, but no later than within 14 days.
13.6.The payment will be returned in the sameway it was paid when purchasing the returned goods.
13.7.The store may withhold the return of payment until it receives the returned goods or confirmation of the return.
13.8.Return of goods should be made immediately to the address: 68JózefówStreet, 63-313 Chocz within 14 days from the date of making a statement of withdrawal from the contract.
13.9.The cost of returning the goods shall be borne by the Customer.
13.10.In case of diminution inthevalue of the item due to the use of the itembeyond the necessary to determine the characteristics and functioning, the responsibility for the above shall be borne by the Customer.
13.11.The returned item must be in the same condition as it was delivered to the buyer,used and damaged items MOVIMET AIRstore has the right not to accept or to repurchase such items at a lower price.
13.12.TheMOVIMET AIRstore stipulates that each returned item must be able to check the condition of the product with the courier and has the right torefuse toacceptit.
14. Complaints
14.1.The subject of sale are new items, free from defects, the responsibility for defects in case of their occurrence is borne by the MOVIMET AIR store.
14.2.Goods purchased at the MOVIMET AIRstore may be complained about in accordance with the principles regulated by the Civil Code on warranty, withintwo years from the release of the item to the customer, if the defect of the item at that time is revealed and proves that the goods are not in conformity with the contract.
14.3.Complaint may be submitted to the MOVIMET AIRstore via e-mail or by letter to the address at 68JózefówStreet, 63-313 Chocz.
14.4.When submitting a complaint, the customer is obliged to provide the reasons for the complaint, his contact details and data necessary to identifythe order. To make a complaint, the "Complaint" printout located on the store's website may be used. The form can be printed and filled out and then sent back to the address of the MOVIMET AIRstore or filled out and submitted online via e-mail.
14.5.When submitting a complaint, the customer in the online complaint form should provide the address fromwhere the courier will pick up the advertised goods at the expense of the store.
14.6.The store has 14 days to consider the complaint and inform the customer about the result.
14.7.In case of positive consideration of the complaint, the customer will receive a refund of thecost of purchase of goods and complaint.
14.8.In case of negative consideration of the complaint, the Customer will receive a refund of the goods with the reasons for the decision.
14.9.Reimbursementwill be made after determining with the Customer the method chosen by him.
15. Ordercancellation/ withdrawal from the contract
15.1.The customer has the right to cancel theorder. This can be done by using the contact form located on the store's website or by phone at 600 134 500
15.2.Cancellationofthe order can be done:
- within2 working days in case of choosing cash on delivery payment
- until the invoice is paid in case of payment by bank transfer based on FV proforma
16. Confirmation of purchase
The store attaches a fiscal receipt or VAT invoice to each product. The store is not responsible for incorrect data provided by the customer.
17. Conclusion and termination of the contract
17.1. These Terms and Conditions are an inseparable part of the contract for the provision of services by electronic means. The conclusion of the contract occurs at the time of commencement of use of the Service, which is in accordance with the acceptance of the provisions of the Regulations.
17.2. The Terms and Conditions shall be made available to the Customer free of charge at www.movimet.pl. The Service Provider shall provide an opportunity for the Customer to print and record the provisions of the Terms and Conditions.
17.3. The Service Recipient may terminate the use of the service at any time without legal consequences.
18. Processing and protection of personal data
18.1. Processing of personal data of the Service Recipientsmayconcern: e-mail address,ordernumber provided when filling out the contact form.
18.2. Processing of personal data of Service Recipientsmayconcern: name, surname, home address, e-mail address, contact telephone number, date of birth, company name, NIP, provided when placingan order.
18.3. The Service Provider undertakes to treat the data as confidential information. In addition, the Service Recipient declaresthat it complies withthe requirements of Chapter V of the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended).
19. Consent to processing of service recipient's data
Each time the Client uses the Service, he/she consents to the Service Provider's processing of his/her personal data provided through the contact form and theorderform of the www.movimet.pl store in connection with the provision of the Service by the Service Provider for the purpose of advertising, market research and research into the behavior and preferences of Service Recipientswith the purpose of using theresults ofsuch research to improve the quality of the Service, and not to remove the identification markings of the Service Recipient relating to the termination ofthetelecommunications network and the data communications system used.
Pursuant to Article 13 (1) and (2) of the General Data Protection Regulation of April 27, 2016, we wish to inform you that:
19.1 The administrator of your personal data is the company Movimet Air Romuald Moździerz, Józefów 68, 63-313 Chocz, tel. 600134500.
19.2 We process your data on the basis of Article 6.1.b. Data Protection Regulation, as it is necessary for the performance of the contract concluded with us, including:
- fulfill the purchase contract,
- responding to an inquiry.
19.3 Your personal data will be processed by us, for the period:
- in the case of entering into a contract with us, the law requires us to process your personal data for tax and accounting purposes for a period of 5 years from the beginning of the year following the fiscal year in which the contract was entered into,
- in the case of responding to an inquiry, your personal data will be processed by us for the validity of the offer, not exceeding 2 years.
19.4 Your personal data may be shared with entities that provide us with email services, IT services and shipping companies, as well as entities authorized under relevant laws.
19.5 We guarantee the fulfillment of your rights under the General Data Protection Regulation, i.e. the right of access, rectification and deletion of your data, restriction of their processing, as well as the right to object to the processing of your personal data if we are not under a legal obligation to continue processing them.
19.6 You have the right to lodge a complaint in connection with our processing of your personal data to the supervisory authority, which is the President of the Office for Personal Data Protection.
20. Intellectual Property Rights
20.1. The Service Provider shall not be liable for any damages arising or which may arise in connection with the content of the store, regardless of the direct or indirect cause of suchdamages.
20.2. All rights to the content contained in the store and being a component of the Services, belong to the Service Provider or third partieswhohave agreed to distribute them through the store under the terms of these Regulations and separate agreements.
20.3. The Service Recipient shall have the right to use the content contained in the store and being a component of the Services only under the conditions set forth in these Regulations and only for personal use.
21. Liability
21.1 The Service Provider is not responsible for the lack of access to the store for reasons beyond the Service Provider's control. Forsecurity reasons ,the Service Provider reserves the right to temporarily suspend the store to repair defects and eliminate possible threats.
21.2. The Service Provider reserves the right to temporarily suspend the store in order to modify, update data, change the content of the store.
21.3. Service provider is not responsible for the situationsmentionedabove.
21.4. Service provider is not responsible for damages caused by operation, errors, deficiencies, interferences, defects, delays in operation or transmission of information technology, computer virus, line or system failure.
21.5. The Service Provider shall not be liable for the use of the store by the Customer ina mannercontrary to the provisions of these Regulations.
21.6 The Service Provider is not responsible for errors and inconsistencies contained in the product information and reserves the right to change the parameters of the products due to design changes and technological reasons.
22. Final Provisions
22.1. The Service Provider reserves the right to amend these Terms and Conditions at any time.
22.2. In the event of changes to the Terms and Conditions, its delivery to the User will be done by making it available on the store pages.
22.3. Amendments shall come into force as soon as the amended text of the Regulations is made available on the store's pages. The User's use of the store after the introduction of these changes istantamountto acceptance and understanding of them.
22.4. The store contains copyrighted content and intangible property protected by intellectual property rights. None of this content on the site may be reproduced or distributed in any form or by anymeanswithout prior permission. The Service Recipient agrees to use the content of the site for permitted personal use only.
22.5. The Terms and Conditions shall come into force on 01.03.2018.
